Safeguarding the Future: Protecting Children’s Rights in India In India, there are various laws and rules that protect the rights of children. The most important one is the Juvenile Justice (Care and Protection of Children) Act, 2015. This law helps in taking care of children and making sure they are safe.
Right to Education: The Right to Education Act, 2009 says that all kids from 6 to 14 years old should get free and necessary education. It stops unfairness in school admission and makes sure the education is of good quality. The Supreme Court in the Mohini Jain case in 1992 said that the right to education is really important under Article 21 of the Constitution of India.
Safeguarding the Future
Right against Child Labor: The Child Labor (Prohibition and Regulation) Act, 1986 bans kids from working in some harmful jobs and makes rules for their work in other jobs. childs are prohibited from any kind of labour work. The Supreme Court in the MC Mehta case in 1996 banned kids from working in industries like making matchboxes, weaving carpets, and making bidis.
Right to Protection from Abuse: The Protection of Children from Sexual Offences (POCSO) Act, 2012 is there to protect children from sexual abuse, mistreatment, and bad pictures. It says what is not allowed and punishes people who do bad things to kids. In a big case in 2011, the Supreme Court said that child victims of sexual abuse need special care and protection of child (male&female).
Right to Nutrition and Health: The Integrated Child Development Services (ICDS) Scheme and the National Food Security Act, 2013 want kids to have good food and healthcare. The Supreme Court in 1989, in the Pt. Parmanand Katara case, said that health is very important under Article 21 of the Constitution. It means kids have the right to get medical help when they are not well.
Right to Protection from Exploitation: The Juvenile Justice Act, 2015 makes sure kids are not trafficked, forced to work, or treated badly. In a case in 2011 called Bachpan Bachao Andolan, the Supreme Court said that we should strictly follow the laws that stop child trafficking and bonded labor.
Right to Identity and Rehabilitation: The Juvenile Justice Act, 2015 also talks about helping kids who have problems with the law. It says they should be helped to change their lives and come back to the society. In a case in 1988 called J.J. Rustomji, the Supreme Court said that the main goal of the juvenile justice system is to help kids become better.
All these cases show that the courts in India are working hard to make sure that children are safe, get good education, are not made to work when they should be in school, and are protected from bad things. The laws and court decisions help in keeping children’s rights safe and make sure they have a better future. It is important for a country to take care of its children because they are the future of the nation.
